1. Agreement to Terms

By accessing or using the services of Empire Coffee Deli, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.


2. About Us

Empire Coffee Deli is a food and beverage business located in Land O Lakes, FL. We offer coffee, deli products, and related services in-store and/or online.


3. Products & Services

All menu items and products are subject to availability.

Prices are subject to change without prior notice.

We reserve the right to discontinue any product or service at any time.

Product images displayed on our website are for illustrative purposes only; actual items may vary slightly in presentation.

Menu items are prepared fresh and may be subject to seasonal ingredient availability.


4. Orders & Payments

Orders are confirmed upon receipt of payment.

We accept the following forms of payment: Cash, Visa, Mastercard, American Express, Discover, Apple Pay, Google Pay, and Samsung Pay.

All prices are listed in US Dollars (USD) and include applicable Florida state sales tax (currently 6%, plus any applicable Pasco County surtax).

A minimum order amount may apply for online or phone orders.

In the event of a pricing error, we reserve the right to cancel the order and issue a full refund.

Gratuity is not included in the stated prices and is left to the customer's discretion.


5. Cancellations & Refunds

Orders may be canceled within 5 minutes of placement, provided food preparation has not begun.

Once an order has entered preparation, cancellations are not guaranteed.

Refunds are issued at our discretion for orders with documented quality issues or errors on our part, and must be reported within 30 minutes of receiving the order.

Refunds will be processed to the original payment method within 3–5 business days.

We do not issue refunds for dissatisfaction based on personal taste preferences once the item has been consumed.

Perishable food items cannot be returned after they have left the premises.

To request a cancellation or refund, contact us immediately via phone or in person.


6. Pickup & Delivery

Pickup Orders: Your order will be held for 15 minutes after the estimated ready time. After this window, orders may be released and no refund will be issued.

Delivery Orders: Delivery is available within a 5-mile radius of our location. A flat delivery fee of $3.99 applies to all delivery orders under $25.00; orders above this threshold qualify for free delivery.

Estimated delivery times are 30–45 minutes and may vary depending on order volume and traffic conditions.

We are not liable for delays caused by third-party delivery services, weather conditions, road closures, or other circumstances beyond our control.

Customers must be available to receive delivery at the address provided. Failed deliveries due to customer unavailability are non-refundable.


7. Food Safety & Quality Standards

All food is prepared in compliance with Florida Department of Business and Professional Regulation (DBPR) food safety standards and applicable local health codes.

Our facility undergoes regular health inspections and we maintain an active food service license.

All food handlers hold valid Food Handler Certifications as required by Florida law.

Hot food is served and held at or above 140°F (60°C); cold food is held at or below 41°F (5°C) in compliance with FDA Food Code standards.

Perishable deli items should be consumed within 2 hours of purchase if not refrigerated, or within 3–4 days if stored properly in a refrigerator at 40°F or below.

We follow FIFO (First In, First Out) inventory practices to ensure freshness.


8. Allergies & Dietary Restrictions

Customers with food allergies or dietary restrictions must notify our staff at the time of ordering.

Our kitchen handles common allergens including peanuts, tree nuts, dairy, eggs, wheat/gluten, soy, fish, and shellfish. Cross-contact may occur due to shared preparation surfaces and equipment.

We make reasonable efforts to accommodate allergen requests, but we cannot guarantee a completely allergen-free environment.

We are not liable for allergic reactions resulting from undisclosed allergies or cross-contact that occurs despite reasonable precautions.

Customers with severe allergies are advised to consult with our staff before ordering and assume responsibility for their dietary choices.

Nutritional and allergen information is available upon request.


9. Alcohol Policy (if applicable)

The purchase and consumption of alcoholic beverages is restricted to customers 21 years of age or older.

Valid government-issued photo identification is required for alcohol purchases.

We reserve the right to refuse alcohol service in accordance with Florida Statute §562.11.

Alcoholic beverages may not be taken off premises in open containers.


10. Loyalty Programs & Promotions

Promotional offers are subject to specific terms and expiration dates as stated at the time of the promotion.

Offers cannot be combined with other discounts unless explicitly stated.

We reserve the right to modify or discontinue promotions at any time without prior notice.

Loyalty points or rewards have no cash value, are non-transferable, and expire after 12 months of account inactivity.

Fraudulent use of loyalty rewards or promotional offers will result in immediate forfeiture and may be subject to legal action.


11. Catering & Large Orders

Catering and large orders of 10 or more people require a minimum of 48 hours' advance notice.

A 50% non-refundable deposit is required to confirm catering orders.

Final headcount and menu selections must be confirmed 24 hours before the event.

Cancellation of a confirmed catering order within 24 hours of the event will result in forfeiture of the full deposit.


12. Health & Safety in Premises

Customers are required to adhere to all posted health and safety guidelines while on our premises.

We comply with all applicable FDA Food Safety Modernization Act (FSMA) and Florida food service regulations.

We reserve the right to refuse service to anyone behaving in a manner that poses a safety risk to staff or other customers.


13. Intellectual Property

All content on our website and marketing materials — including logos, images, text, and designs — are the property of Empire Coffee Deli and may not be reproduced without written permission.


14. Limitation of Liability

To the fullest extent permitted by law, Empire Coffee Deli shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or products.


15. Governing Law

These Terms and Conditions are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes will be resolved in the courts located in Pasco County, Florida.


16. Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. Continued use of our services after changes constitutes acceptance of the new terms.
